Terms and Conditions

1. Terms & Conditions and Registrations
1.a By signing the registration form the signer (hereby called "the Client") enters in to a binding contract with 'Musix with Music' and agrees to all the Terms and Conditions set out here.
1.b The Terms and Conditions may be altered without notice or notification by management of Musix with Music as Musix with Music determine are reasonable or necessary for the safetly of children, or the protection of Musix with Music staff, or for the protection of Musix with Music's interests.
1.c Musix with Music reserves the right to reject registration forms. When this occurs, Musix with Music will contact the Client to inform of such a decision.
1.d The Client must provide a valid mobile phone number, email address and land address on the registration form. Registration forms that do not supply all three contact details may be rejected. Musix with music uses:
i. the land address for term notes and invoices
ii. email addresses to announce changes and updates
iii. sms to announce last minute changes including but not limited to teacher absence, canceled lessons and urgent updates.
2. Packages
2.a Musix with Music offers four (4) primary packages which are advertised at www.musix.com.au/packages
2.b Musix with Music may makes changes to the fee structures at anytime. Where fee changes are made Musix with Music will notify the Client via email, post or sms two (2) weeks before the end of the term preceding the effective changes. This will allow the Client a fair amount of time to consider whether they are able to continue in the following term.
2.c Band rehearsal duration will vary depending on the number of Clients registered for the school's band program.
2.d On occasion a participating school might negotiate an alternative package arrangement. These arrangements are outlined in the "invite to join" note to which the registration form is attached.
3. Fees
3.a The Client agrees to pay all invoiced fees and charges on time, including but not limited to quarterly band fees, instrument hire, late fees, late collection of child fees and accessories.
3.b All invoices are due within twenty-one (21) days of the invoice date.
3.c Musix with Music reserves the right to add up to 15% of invoice amount to any outstanding invoice.
3.d Where invoices remain and a debt collecting agency is requested to pursue outstanding invoices, the Client agrees to pay all costs involved with this process.
3.e The Package the Client registers for is usually determined by the school administration. This package cannot be negotiated by a pre-registered Client, except when the Client desires to register for the Platinum Package or for Private tuition only.
3.f Packages prices are negotiated with the school administration
3.g Fees will be adjusted for the Client enrolling or registering mid-way through a school term accordingly. The package fee will be divided by 9 and multiplied by the number of lessons in which the Client's child will participate, and an additional 15% of the original amount will be added to cover registration and administration. In the event that the adjusted amount is higher than the normal package price, only the package price will be charged.
3.h All fees are payable directly to Musix with Music. No money should be given to the teachers who work for Musix with Music. Three (3) modes of payment are available so far:
i. Paypal facilities are available through our website. The Client who chooses to use Paypal also agrees to pay an extra 2.5% to cover merchant costs. In the event the Client forgets to add 2.5% when paying, Musix with Music will add this amount to their next invoice. The Client who chooses this option must add their invoice number (as shown on their most recent invoice) to the "description" on the PayPal site.
ii. Direct Deposit. On each invoice the bank details of Musix with Music are provided. The Client can make a bank transfer using their internet banking facilities. The Client who chooses this option must add their invoice number (as shown on their most recent invoice) to the "description" or "reference" on their Banks transfer site.
iii. Cheques and Money Orders can be posted to the PO Box of Musix with Music which is provided on each invoice. Cheques and Money Orders must be written out to Musix with Music. The Client who chooses this option must either write their most recent invoice number on the back of the Cheque or Money Order, or attach the payment slip from the bottom of their most recent invoice which has printed the invoice number.
4. Discontinuing
4.a When registering, the Client is committing to four (4) school terms unless prior arrangements are made with Musix with Music. This commitment includes band fees for the nominated package for four (4) school terms, and
4.b An enrollment or registration remains valid from the date of enrollment until the end of the current term. Unless otherwise advised, continuity of tuition will be assumed and invoiced accordingly.
4.c In order to discontinue after the first year of being a part of your school band, the Client must send written notice to Musix with Music indicating the intention to withdraw from the band program before the last Friday of the last term the Client intends to be a part of the school band. Withdrawals will be effective at the commencement of the next school term. Written notice may be email to This e-mail address is being protected from spambots. 4.d Notes handed to teachers or the school that do not make it to Musix with Music office before the last Friday of a given school term will not be considered sufficient notice. In this event the Client may be invoiced for a term for which they did not plan to participate.
4.e Verbal notice given to a teacher or to school staff will not be considered sufficient notice of discontinuing. In this event the Client may be invoiced for a term for which they did not plan to participate.
4.f. Musix with Music understands that children sometimes change their mind before the first class begins. For this reason Musix with Music allows a "cooling down period". This period varies from Client to Client however there are two (2) events that mark the "cooling down period" for each Client.
i. The "cooling down period" commences when the registration is received by Musix with Music.
ii. The "cooling down period" concludes when Musix with Music posts the first invoice prior to lessons commencement.
5. Child safety
5.a It is the responsibility of the Client to ensure the Child arrives at least 5 minutes prior to lesson commencement to allow time to set up their instrument.
5. b It is the responsibility of the Client to ensure their child is collected from lessons on time.
5.c The Client is aware that teachers often have extra classes at a different location after teaching for Musix with Music. As such, it is not possible for Musix with Music teachers to wait after classes for children to be collected without losing income from alternative sources.
5.d In the event that a Musix with Music teacher is required to wait for parents after lessons for more than seven (7) minutes, the Client will be invoiced at a minimum rate of $50 per half hour (30 minutes) at 30 minute increments. In the event that a Musix with Music teacher loses more than the $50 due to waiting for a child to be collected, the Client will be invoiced at the greater amount plus a minimum of $25 per half hour. This fee will be titled a "late collection of child fee".
6. Practicing
6.a The Client agrees to assist their registered child/children to practice their chosen instrument for a minimum of 10 minutes on a minimum of 5 days every school week for children in their first year of participating in a school band or private tuition.
6.b The Client agrees to assist their registered child/children to practice their chosen instrument for a minimum of 20 minutes on a minimum of 5 days every school week for children in their second year of participating in a school band or private tuition.
6.c The Client agrees to assist their registered child/children to practice their chosen instrument for a minimum of 25 minutes on a minimum of 5 days every school week for children in their third year of participating in a school band or private tuition.
7. Group lessons
7.a The Client understands and accepts that the Bronze, Silver and Gold Packages, and their variations, are based on group lessons. This means that Musix with Music teachers' income is based on a pool of income. For this reason, the Client registered in one of the aforementioned packages will not receive discounts or reduced fees due to absence, illness, vacation or any other reason for missing weekly group lessons.
7.b Where ever possible Musix with Music aims to keep group lessons between four (4) and seven (7) children per class.
7. c Where ever possible Music with Music aims to group lessons in "like" instruments (eg woodwind or brass) or in student abilities.
8. Private tuition
8.a Private tuition is any lesson where there is purposefully one child in the class. The Platinum Package is an example of such classes.
8.b Ten (10) days notice must be given to the office of Musix with Music if the Client wants to cancel a lesson and receive credit for the following or a make-up lesson.
8.c Where notice is less than ten (10) days the lesson is forfeited and will not be credited or refunded. Make-up lessons are not guaranteed in these circumstances. Make-up lessons will be at the discretion of the Teacher and his or her availability.
9. In the event that a Teacher needs to cancel a lesson the Teacher will try to make up the canceled lesson before the end of the school term. Where a make-up lesson is not possible, the canceled lesson will be credited for the next term's invoice.
